Agreement to Terms

These Terms of Use ("Terms") constitute a legal agreement between you and SABIO LLC ("SABIO," "we," "us," or "our"), a limited liability company registered in the State of Nevada, United States. By downloading, installing, or using JotScreen ("the App"), you agree to be bound by these Terms. If you do not agree, do not use the App.

License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use JotScreen on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. This license does not allow you to:

  • Distribute, sublicense, lease, or lend the App to third parties
  • Make the App available over a network where it could be accessed by multiple devices simultaneously
  • Copy, decompile, reverse engineer, disassemble, modify, or create derivative works of the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App

Your Content

You retain full ownership of all screenshots, annotations, and other content you create using JotScreen ("Your Content"). We do not claim any intellectual property rights over Your Content. You are solely responsible for the content you capture, create, and share using the App, including ensuring that you have the right to capture and distribute such content.

In-App Purchases and Subscriptions

JotScreen offers premium features through in-app purchases and/or subscriptions, processed via Apple's StoreKit framework. By making a purchase, you agree to the following:

  • Payment. All payments are processed by Apple through your Apple ID account. We do not collect or store your payment information.
  • Pricing. Prices are displayed in your local currency within the App and may vary by region. Prices may change at any time, but changes will not affect active subscriptions until their next renewal.
  • Subscriptions. If the App offers subscriptions, they automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. You can manage and cancel subscriptions in your Apple ID account settings.
  • Free trials. If a free trial is offered, it converts to a paid subscription at the end of the trial period unless you cancel before the trial ends. Unused portions of a free trial are forfeited upon purchasing a subscription.
  • Refunds. Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.
  • Restoration. You can restore previously purchased content on any device signed in with the same Apple ID at no additional cost.

Acceptable Use

You agree not to use JotScreen to:

  • Capture, store, or distribute content that you do not have the right to capture or share
  • Capture content that is illegal, defamatory, obscene, or violates any third-party rights
  • Violate any applicable local, state, national, or international law or regulation
  • Circumvent, disable, or interfere with security-related features of the App
  • Attempt to gain unauthorized access to any part of the App or its related systems
  • Use the App in any manner that could damage, disable, overburden, or impair our infrastructure

Intellectual Property

JotScreen, including its design, code, graphics, user interface, logos, and trademarks, is the property of SABIO LLC and is protected by United States and international copyright, trademark, patent, and trade secret laws. These Terms do not grant you any right to use the SABIO or JotScreen name, logos, or trademarks.

Analytics and Data

JotScreen collects anonymous usage analytics to improve the App. By using JotScreen, you consent to this data collection as described in our Privacy Policy. You may opt out of analytics collection as described in the Privacy Policy.

Updates

We may release updates to JotScreen from time to time. These updates may include bug fixes, new features, or changes to existing functionality. While we are not obligated to provide updates, certain updates may be required for continued use of the App. Updates are delivered through the Apple App Store and are subject to Apple's terms.

Disclaimer of Warranties

JOTSCREEN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SABIO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE JOTSCREEN, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless SABIO LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of JotScreen, your violation of these Terms, or your violation of any rights of a third party.

Apple-Specific Terms

You acknowledge and agree that:

  • These Terms are between you and SABIO LLC only, and not with Apple Inc. ("Apple"). SABIO LLC, not Apple, is solely responsible for JotScreen and its content.
  • Apple has no obligation whatsoever to furnish any maintenance and support services with respect to JotScreen.
  • In the event of any failure of JotScreen to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to JotScreen.
  • SABIO LLC, not Apple, is responsible for addressing any claims by you or a third party relating to JotScreen or your possession and use of it, including but not limited to: (a) product liability claims; (b) any claim that JotScreen fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
  • In the event of any third-party claim that JotScreen or your possession and use of it infringes that third party's intellectual property rights, SABIO LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of JotScreen shall be resolved in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of such courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Termination

We may terminate or suspend your license to use JotScreen at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive any termination.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SABIO LLC regarding your use of JotScreen and supersede all prior agreements, understandings, and communications.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. If changes are material, we will provide notice within the App. Your continued use of JotScreen after changes are posted constitutes acceptance of the revised Terms.
